With the end of the 2021/22 tax year it is the time to look back at some of the big
Framework contracts allow commissioners to tender out a service for multiple providers that can fulfil either one or multiple services. They usually do this via a Selection Questionnaire (SQ) and a small number of method statement for a bidder to complete. The framework may also include multiple lots, and in this case a bidder would usually have to complete method statements per lot. The commissioners will either say there is a minimum score to get on to the framework (with unlimited providers), or they may say that only a specific number of providers can be on the framework. The commissioners may also leave the framework open indefinitely for bidders, or have annual ‘windows’ where bidders can apply.
If you are successful in getting on the framework, there is no guarantee of work, the commissioners will instead have ‘call-offs’. These are mini-competitions or requests for quotes for specific elements of the service. A good example of this is social care, where if you are on a framework, then you will be asked to quote or do a mini-tender for a specific package of care.
Please note, that frameworks are now often also called Dynamic Purchasing Systems (DPS).
Sole provider contracts are where commissioners contract with only one provider. It may be not that their are sub-contractors under the provider, but the commissioner only deals with and contracts directly with the one provider. This simplifies reporting arrangements for the commissioner, though it does have the risk of putting all of the commissioners ‘eggs in one basket’.
In terms of bidding for a sole provider contract, they are usually significantly more difficult for a provider to win. There is often a lot of competition for these contracts as the rewards are greater; guaranteed work and income of a set number of years. Due to the rewards, the amount of work required is also greater, with often many more and detailed method statements to complete versus a framework application. You will need to be very clear in your answers, have as many examples and case studies ready for inclusion, as well as added value and innovation to impress the commissioners.
If you a smaller provider, keep an eye out for frameworks; you have a much better chance of getting on to them and picking up semi-consistent work. If you are a bigger provider, then sole provider is the way to go, with bigger rewards. Even as a smaller provider, it may be worth the gamble to apply for a sole provider contract to take your business to the next level.
